What Happens If My Property Comes Back Damaged?

If your tenant causes damage to your property during their tenancy that is beyond reasonable wear and tear, you may be entitled to claim a portion of the bond to repair damages. However, many landlords are not aware that you only have 10 business days from the end of a tenancy to make a claim.

During their final inspection of the property, your property manager will advise you what constitutes damage and what is considered wear and tear. If your property manager believes the tenant has damaged your property, here are the three steps you’ll need to take to make a claim from the bond…

The issue for many investors, however, is that the duties of a property manager often go unnoticed, and when they’re doing their job well, your investment property hums along like a well-oiled machine.

But that’s no accident. Here’s what property managers do to earn their fee…

Step 1: Agree on the bond division

You and your tenant need to agree on how the bond will be divided. That is, how much money you need to fix the damage, and how much will be returned to the tenant. Your property manager will set this out in a Bond Claim form and send it to the Residential Tenancies Bond Authority (RTBA). Keep in mind that it’s illegal to ask a tenant to sign a Bond Claim form that does not show the amount you will receive.

Step 2: Resolve any disputes

If you and your tenant do not agree on the division of the bond, your property manager will apply to VCAT for a hearing to reach an agreement. If VCAT directs the RTBA to release funds following the hearing, your property manager can submit the claim form and the order to ensure you receive the funds.

Step 3: Your bond claim is paid

The RTBA will check that all documentation is in order and will transfer the money into your bank account within two to three business days.
